What is Trademark Renewal?
A registered trademark is valid only for 10 years, after which it needs to be renewed. A trademark can be renewed as it is or with changes and alterations. A letter of reminder is sent by the Registrar of Trademarks, 6 months prior to its expiry, for renewal. The application for the renewal of a trademark is the form TM-R. The trademark can be indefinitely renewed and the charges for renewal depends on case to case basis.
Important Time periods for renewal of a Trademark
One Year before expiry of the Trademark Registration: The owner of the trademark can apply for renewal of the Trademark registration one year before the trademark registration is due to expire.
6 months prior to expiry of the Registration of the Trademark: Notice will be sent by the Registrar of Trademarks that the registration period will be expiring.
6 months after expiry of the Registration of the Trademark: The owner of the trademark can apply for renewal of the Trademark registration within six months after the trademark registration has expired.
